The South African Labour Guide helps provide some information about what you are permitted in conditions of leave:

1. Annual holiday
This type of time off refers to compensated time off work, that every single employee is designated. In accordance with the South African Labour Guide, every member of staff is entitled to 15 days remunerated time off for each annum. Public holidays that happen inside a period of time off is not able to be calculated as annual holiday.

"All employers should have in place an Annual Leave Policy which regulates the accumulation of annual leave, placing limits on the amount of annual leave that may be accumulated,." states the SA Labour Guide.

2. Maternity leave
The Act permits pregnant employees as much as four months of unremunerated time off to get ready, give birth and then care for their baby. Expecting employees may obtain maternity time off a month ahead of their due date (or earlier or later as agreed upon by their doctor). According to the SA Labour Guide, you're actually entitled to your maternity leave in addition to your twelve-monthly time off. "Annual time off continues to accumulate whilst you are on maternity leave," it states.

3. Sick leave
Sick leave is based on a 3-year cycle under the same job. "The number of days of sick leave due to an employee is equal to the number of days he/she would have worked over 6 weeks," states the SA Labour Guide. While the fine points of sick time off are complicated, the SA Labour guide to some extent makes them easier by by rationilising "Working a 5 days week entitles an employee to 30 days sick leave every 3 years while working 6 days per week entitles them to 36 days per 3 years". In case you are absent from work for a period longer than two consecutive days, your employer is allowed to ask you to offer a medical certificate as proof of your sickness (Monday and Friday do not count as two consecutive days, being sick the before or after a public holiday do not count either. You will not need to prove your illness in these circumstance unless company policy dictates this).

4. Study leave
Since South African Labour Law does not cater for study leave, this matter must be arranged woth your employer. In some situations, employers insist that academic leave has to be deducted from the employee's yearly leave allocation.

5. Family commitment time away
According to the SA Labour Guide, If you have worked in one employment for more than four months for more than four days per week you are entitled to 3 days leave a year for this purpose. This type of time away is in addition to annual leave, however doesn't accumulate if unused in the stipulated time period. "When a member of your immediate family passes away (this being a sibling, parent, child, grandfchild or grandparent), your spouse or life partner passes away or you child is ill", states the SA Labour Guide.

If you are unsure about holiday it is recommended to talk to a person who's familiar with the labour law or a designated HR representative at your company.
