Filing a class action lawsuit can seem pretty intimidating. If you or someone you love has been harmed by a company’s or individual’s actions, products, services, or negligence, though, you need to know how to file this type of lawsuit. It can help you and others who are in the same situation get the compensation you need to put your lives back together. Here’s a bit of information on how the process of filing this type of lawsuit works. We’ll just give you a scenario to help you see how it works. A Scenario
First, let’s say that your doctor has just prescribed you some new birth control. You know about basic warnings like not smoking while taking birth control and not taking the pill if you have high risk of blood clots. A few months later, you suffer from deep vein thrombosis and nearly die because of a pulmonary embolism. You spend several days in the hospital. Your first step is to find an attorney. Make sure you’re working with an attorney who does class action lawsuits, as not all law firms handle them. If he thinks you have a good chance of winning, though, you may not have to pay any fees. Instead, the attorney will just take a percentage of whatever you get from the court when the case is over.

File it in Court

You’ll have to file the claim in court next. There will be a fee for this, and you’ll probably also have to pay to get notice to the defendants in your case. Next, the judge will require that you send notice to other parties in your class – that is, others who have been harmed in similar ways by the same birth control pill.

Oftentimes, this notice is published in major paper publications, on television commercials, or through letters sent to individuals. Once you have several plaintiffs together, you can get class status through the courts. This status will allow you to have one single trial together, and it will simplify the entire process.
