UK Rental law may be complex, but many problems may be avoided by drafting a simple written agreement. Landlords or letting agents will draft the agreement to include all the terms of letting the apartment, house, building or flat to the tenant. UK rental law does not require that a rental agreement be devised, but to avoid lawsuits and other disagreements, experts recommend a tenancy agreement. Inventory services are also recommended to avoid disputes regarding property damage.

A well drafted tenancy agreement considers both the needs of the tenant and the landlord. The tenant needs to ensure that the home is secure with working appliances and the home is free from intrusions. The landlords need to maintain the condition of their property, while receiving prompt payments from the tenant. As long as the conditions are met by both parties, then the rental relationship is viable for all.

The rental agreement should list the address of the rental property, the name of the tenant and landlord and the terms of the agreement. This may include the length of time the tenant is allowed to occupy the property or the number of tenants allowed on premises. The length of the tenancy agreement will depend the landlord's stipulation.

Most landlords will also draft an inventory. This document lists the condition of the property at the time of rental, including any furniture, fixtures, lighting or other items left in the rental property at the time of occupation. A check-in report will be accompanied by photos before occupation of the property. Both the tenant will sign off on the document. This document will be compared to the check-out photographs and description to determine if the deposit will be returned. This document eliminates disputes between landlords and tenants. If the case goes to court, the pictorial evidence will help settle the case.

New rental law includes a tenancy deposit protection scheme for short-hold tenancy. This new law ensures that disputes over deposits be fairly solved by other means than going into a court of law. Rental law solicitors are often available free of charge to help clients resolve these types of disputes in a minimal amount of time.

The Act of Parliament regulates the contractual agreement between the tenant and landlord when a tenancy agreement is signed. The terms of the agreement cannot be contracted out by any form of the private agreement. Before leasing a property, ensure that all of the proper documents are signed for your protection.
