Travel consumers are well protected by the Package Travel Regulations 1992

Holidaymakers have never been so well protected when travelling abroad because of the Package Travel Regulations 1992, which was created and implemented following a European Directive (90/314/EEC). This was in response to their being a lack of rights for the consumer who had a package holiday contract.
The UK adopted this directive in the form of the Package Regulations 1992, which has had an amazing impact on the rights British travellers now have. The regulations outline how the parties to the contract should be identified and what information consumers should be provided with at the beginning of the contract.
The regulations detail that a 'Package' is a pre-arranged combination of at least two components. When they are sold or offered for sale, they must be done so at an all-inclusive price and when the contract is for more than 24 hours or has overnight accommodation, there is transport, accommodation and a 'tourist service' not 'ancillary to transport or accommodation' and accounting for a significant proportion of the package.
The regulations even offer the same consumer protection for DIY packaging, where people book their own holiday over the internet. The regulation states:
1. The submission of separate accounts for different components shall not cause the arrangements to be other than a package.
2. The fact that a combination is arranged at the request of the consumer and in accordance with the specific instructions (whether modified or not) shall not of itself cause it to be treated as other than pre-arranged.
The information and the rest of the Package Regulations 1992 should assist you in arguing your case, but it is important that you read the contract you have with a tour operator thoroughly, before setting off on holiday.
