What Is a Class Action Lawsuit?

A class action lawsuit is a means of streamlining very large cases. In some court cases, class actions are called for simply because of the sheer number of claimants involved. Class action lawsuits are primarily seen in the United States, though there are other nations that have similar laws. In many cases, individuals will have received notices in the mail that they’re eligible to join in a class action lawsuit against one entity or another. In some cases, there may be large payouts involved. In others, each claimant in the class may only receive small payout amounts for having joined the class.

Understanding How Class Actions Are Started

There are specific criteria that have to be satisfied before a class action lawsuit can be filed. Principally, there are four things that must hold true about the suit.


• There must be too many claimants to make individual lawsuits practical
• Each of those claimants must have the same issue with the defendant
• The case being presented must be typical of all the claimants
• The claimant’s interests must be protected by the representation


In many cases, you may hear lawyers describe these characteristics as “numerosity, commonality, typicality and adequacy.” For very large groups of claimants, class action lawsuits are oftentimes the easiest way to go about filing a claim against anyone or any company. Oftentimes, these suits are filed against the manufacturers of defective products or the providers of defective services. Class Action Lawsuit Settlements

If you’ve been offered to become part of a class action, you may wish to consult with an attorney first. While class action lawsuit settlement amounts can sometimes be impressive, they can also be much less than that, if the class action is being used as a way to allow the company to get out of paying very large sums of money for damages. As an example, you may receive a very small amount for joining a class of plaintiffs who are suing over an Internet service that didn’t perform as advertised. In contrast to this, some lawsuit settlement amounts for claims that arise over defective medical products can be very high, which is not too surprising given the amount of damage such devices can do.

There are some cases where you can pursue a lawsuit or settlements as an individual or as a class and sometimes doing the former may work out better for you in the end. Some attorneys will offer these consultations for free and, if they decide to take your case, they may do so on a contingency basis. Class action lawsuits are excellent options if you’ve been wronged by a company or product and if you’re only one of a group of such people. Currently there is no Osmoprep class action and individual Osmoprep lawsuit cases are being filed by people suffering from kidney damage.
